Massachusetts is an “Attorney Closing” State, which means we do not have title company settlement agents as many other states do. Mortgage closings must be conducted by an attorney.

Talbot Law Offices, P.C. conducts real estate closings throughout Massachusetts. We have title examiners and land surveyors in every county of Massachusetts and we will travel to the borrowers location to close a loan when our office locations are not convenient for them. 

The Procedure

Once a lender sends a “Title Order” or “Request for Title Commitment” to one of our offices, the process begins. 

Our office:

  • Orders and reviews a title examination

  • Issues a title commitment to the lender

  • Obtains a municipal lien certificate from the town where the property is located to determine the status of tax, water and sewer payments

  • Obtains a plot plan of the property if required by the lender

  • Conducts the closing

  • Certifies the title

  • Records the mortgage at the appropriate Registry of Deeds

  • Issues the title insurance

Information our office needs from the Lender

Please include the following information in the “Title Order” and fax or email it to our office: 

  • Names and telephone numbers of the borrowers

  • Address of the property

  • Loan amount

  • For a Purchase: the purchase price and a copy of the Purchase and Sale Agreement

Once we receive the “clear to close” from the lender, we will schedule the closing with the borrowers at the Registry of Deeds (for a Purchase), our office or in their home.

Closing Packages 

Our office can accept closing packages via overnight mail, email or by downloading through a web site. We can also generate the closing docs ourselves if required by the lender.
